Under and by virtue an Order To Execute Upon The Defendant’s Real Properties and To Compel Defendant Foster To Produce Evidence ordered and entered February 15, 2021 and signed by Superior Court Judge Jerry Tillett, the Dare County Sheriff’s Office has seized and taken into control and will sale at public action on May 04, 2021,at 10:00 A.M., to the highest bidder for cash all the rights, title, and interest that Desmond Foster, Jr. and Foster Boats has in the following property:

All that certain lot or parcel of land situated in the city of Hatteras, Hatteras Township, Dare County, North Carolina and more particularly described as follows:

ADDRESS:            57181 Islington Ct., Hatteras, North Carolina   27943

SEE EXHIBIT “A” ATTACHED HERETO AND INCORPORATED HEREIN BY REFERENCE.

A 2/3 interest in property beginning at an oak tree stump by which is also a concrete marker, said stump being in and marking the A. S. Austin, Jr. property, now Joe Richard Sewell, South corner, said beginning point being also on the Southeast side of the existing road leading from the N. C. State Highway to the Sewell, formerly Austin, property and by these lands, running thence from the beginning point along the Sewell, formerly Austin, Southeast line North 61 degrees East 120 ft. to a concrete marker;  thence continuing along the Sewell, formerly Austin, Southwest line South 32 degrees East 141 feet, more or less, to a concrete marker in the D. W. Balance tract Northwest line; thence along the D. W. Balance Northwest line in a Southwesterly direction 200 feet to a concrete marker; thence in a Northwesterly direction 154 feet, more or less, to a concrete marker situated in the Southeast margin of the aforesaid road, said concrete marker being 60 feet in a Southwesterly direction along said road from the point of beginning; thence along the East margin or right of way of said road in a Northeasterly direction 60 feet to the point of beginning.

A cash deposit or cashier’s check (no personal checks) of five percent (5%) of the purchase, or seven hundred fifty dollars ($750.00), whichever is greater, will be required at the time of the sale.

This property is being sold subject to all prior liens and encumbrances pending against the property.
